Women in Judiciary
- Recently, Attorney General stressed on the need for greater gender sensitisation among members of the judiciary and improving the representation of women in the judiciary for a more balanced and empathetic approach in cases involving sexual violence.
A Glance at Women’s position in Judiciary
- As of now, the share and magnitude of lady lawyers or judicial members is very less.
- Eg: there are only 17 female lawyers in comparison 403 male lawyers and only 2 female supreme court judges in comparison to 32 male judges in the Supreme court.
- There is a lack of Gender sensitisation to a large extent especially at the High court and Supreme court level.
- In solving the case of sexual violence, there need to be increase in number of women judges because a factor of empathy might deliver a pleasing justice.
- Generally lawyers and judges are morally represented as correct but sometimes there is personal discretion towards granting judgements especially in case of male members.
- Eg: Granting of Bail or Anticipatory bail.
- The major issue lies with the collegium system for appointment of HC and SC judges which need to be looked upon because even till now no women has reached to the CJI position.
Way Forward
- The foremost thing is to bring a mindset and societal change for treating women equally as men.
- Judges need to be trained to place themselves in the shoes of the victim of sexual violence while passing orders and follow an emphatetic approach instead of sympathetic approach.
- The collegium system needs to be more open and transparent.
- Compulsory courses on gender sensitisation in law schools can be integrated in curriculum.
Conclusion
- Women should be given equal chance as men in all the spheres and societal change and increase in representation is the key towards making women’s position more strong.
